Rape charges dropped in Duke lacrosse case

DURHAM, N.C. -- Prosecutors dropped rape charges Friday against three Duke University lacrosse players accused of attacking a stripper at a team party, a defense attorney said. Joseph Cheshire, an attorney for one of the three players, said charges of kidnapping and sexual offense remain in place. The DA's office confirmed to ESPN's George Smith that the accuser is aware the charge is being dropped. Cheshire said Friday that the accuser now says she does not know if she was penetrated, which he said led District Attorney Mike Nifong to dismiss the rape charges. Nifong did not immediately return calls seeking comment. The accuser, a 28-year-old student at North Carolina Central University, has said three men raped her in a bathroom at a March 13 team party where she was hired to perform as an exotic dancer. The players -- Dave Evans, Collin Finnerty and Reade Seligmann -- all say they are innocent. Their attorneys have consistently said no sex occurred at the party and have cited a lack of DNA evidence in the case as proof of their clients' innocence. "It's highly coincidental," Cheshire said, that the charges are being dropped a week after the director of a private DNA testing lab acknowledged that he initially, with Nifong's knowledge, withheld from the defense test results showing none of the players' DNA was found on or in the accuser's body. Testing also showed that genetic material from several males was found in her undergarments and body.

Interesting... I'm still withholding judgement on this one.... just too many things that don't add up either way. Also curious what the results of her paternity test/DNA testing on the baby will show.

personally i think its rediculous her story had more holes in it than a block of swiss cheese and the fact that she had multiple male DNA in her system that wasnt the players proves a lot to me

It's about damn time because from witness testimony alone they had no case, with supporting lack of physical evidence. Especially when your coworker says your story is false and never happened.

Forreal the interesting issue will be if the district attorney takes any heat because you know the only reason he took it to trial is to get reelected

yeah but "charges of kidnapping and sexual offense remain in place." Thats pretty serious there, but I can't see any of this helping the other charges.

Yeppers...They are still looking at 20+ years... yeah i would still be concerned because how can you not but i think it's pretty obvious from the facts of the case that she lied and nothing close to what the allegations were actually happened.

Sorry this all started because some 'chick' (for the lack of a more colorful word) was hoping to get paid by a bunch of supposed to be rich boys... Then some corn cobb in the Arse DA wanted to get re-elected and felt this was the best way to get in the news for free....This was just a (Mark insert smile here) load of crap! :motz:

Yeah! Everyone knows Lacrosse players are gay! Kidding, kidding Seriously once the victim has been found to be dishonest or untruthful then her testimony is shot for the rest of the case. No jury is going to sentence someone on a discredited witnesses testimony.

how did she get kidnapped??:idk: That's what I'm wondering. I'm not surprised that charges were dropped, though.

Yeah! Everyone knows Lacrosse players are gay! Don't make me hurl a solid rubber ball at you with it going well over 100mph. It inflicts a tremedous amount of pain as well. I still have battle scares from lacrosse in high school. As a face off middie, I pretty much don't have a straight finger on my hands because they have all been broken so many times.
