Got introuble need help!!!!!!

Ok i got busted again. was at the hershey concert(breakin benjamin, staind, 3 doors down) in the parking lot yesterday and we where gonna drink some beer. welp we get them out and the girl in the back seat just starts drinkin like shes allowed and of coarse MR. undercover cop knocks on the window with his badge. so basically fcuked. any ways he writes us up for a NON-traffic violation of having beer in hand and being under 21 and smelling like beer. but they only write up 3 of us out of the 5 ppl in the car and they where gonna do a breathalizer but then decided they where not gonna. so no one got a breathalizer. they said the findes are ususaly a little under 300 and i will prob lose my liscence for 90 days at the most. what should i do with this? should i go with not guilty

If you plead not guilty, I guarentee (sp, cause it just looks wrong!) you that the cop is going to show up. And I'll tell you that it'll be like a 98% chance that the judge rules in favor of the cop. If you make up a story, then you could also get into even more trouble cause I think that is contempt so then the judge can throw you in jail right then and there. If anything, the people that weren't drinking should have said, "Take me for a breathalizer" cause at least then you could have used that in your favor. I actually would opt for blood test over a breathalizer cause by the time you get taken to a hospital, they admit you to draw the blood and the results come back, it would be less than the breathalizer. (just some input for those who drink, get a blood test! NO BREATHALIZER!!!) I'd say you really can't do anything though. Pay the fine, take the suspension. You could try looking into the local laws and everything and seeing if you can get out of it cause if the cop said you "smelled like beer" but didn't take you for a breathalizer/blood test, then it could possibly get thrown out. The only one that seems to be like not a chance in hel! to get out of it is the girl.

I have a similar situation that happend to me.

I dont know how it works in the USA concerning your case but, up north the cops got ta have a proof of what he is accusing you of. If he cant proof you drank beer that day with a withness that testify that you did drink or a breath-analyser test to proof that you had some alcool in your bood,I just wonder how a decent judge can just decide that he beleive the story of the cop without any proof outside of his testimony... If you have been caught before for the same offense and it is recorded somewhere, I think it will be simplier to pay the fine... :sorry:

But if you have gotten pulled over for D&D, which I have and demanded a blood test, most cops will refuse it cause they know the time frame that it will be completed in. It is not as easy as just going down to the station and blowing and getting the results. You are not considered a priority when you go to the hospital for a blood-alcohol test. This I know cause I've done it. I had like 5 beers, got pulled over after I hadn't drank any for almost 3 hours. The cop wanted to give me a breathalizer and I said take blood, said ok, took me down to the hospital where I sat there for close to four hours waiting. He got pissed, said something and they told him that I am not considered a priority but the people coming in on the ambulances are. I have talked to many cops about this as well as many military police and they hate it when people say take blood cause they know the time that they wait will have more alcohol disipate from their system. So my advice is not completely inaccurate.

ok yeah but if i do my community service, the other one that i got at the beach doesent go on my record. yeah i know lately i have been fcuking up alot and i have to get my act together.

The other night we were hanging out at the canell after dark (three of my friends were totally screwed up on beer) and the others were all drinking and had beer in there hands...........i think we were to loud and a farmer called the cops, well we were on our way home .i was driving with three in my car (provisional licence) and there were two cars with intoxicated KIDS in it(all under 17) and one car with a 14 year old driving drunk kids home well we were all in single file tring to get onto the rode with about 1/4 mile of canell left an we see head lights....i almost **** my pants b/c i was going to court the next morning and even though i wasent drunk i had a couple drinks and knew it would show up on the breathalizer so i was scared...... then the spot light comes on and we KNEW it was a cop for sure so all the cars stopped (of course i was in the front closest to the cop) so i got out and just told the 100 % truth about everything except that the drivers were all drunk or had drinks in them and ON them lol but he was like "well son i appreciate you trien to get these kids out of here and just make sure none of you are to drunk to drive home, do you feel that any of you are to drunk to drive?" i was like "no sir i think we are good but if you would like the unlicenced driver will leave his car here till morning" (because he checked all our licences) he was like " well if you can get it out of here right now then do it" i was just SO suprized at how cool he was so i said thatnk you for being cool about it and he laughfed and i said we will just take it home b/c my friend lived like 2 miles away.....so we got to my friends house and my buddy will downed the rest of the beers lol i think that scared me out of drinking, even though i wasent really drinking lol

well yeah i have also met cops that where cool and would just let you go but for some reason lately i have been getting the cops that are jsut stuck up. i just dont wanna really lose my liscence. caseu then i cant ride my bike. but on a brighter note the cops for somereason called my parents. y i dont know cause im 20 but my mom talked to the cop and now the cop is saying we all had a beer in our hand which is total BS so i think im just gonna go with guilty casue this guy is gonna make it a pain in the arse. now about the good part, the violation will NOT affect my insurance and it will NOT go on my record. so that is y i dont think im gonna fight it. but i will try and reschedule court dates if i have to go to try and get the cop not to show. lol

Drinking in bars and restraunts-- you can get as ShEEtfaced as your own Dumb@$$ lets you, or until the place stops serving you.... LONG as u stay there. CALL A CAB or have a friend take you home, go stright to the car and dont be a idiot on the way and no cop would give ya a ticket and if they do the judge would toss it... for being responsible and gettign a ride home, not walking, or DRIVING.( of course all while u are 21 or over.. under and u are screwed for all kinds of stuff) For you specificLLY-- IF HE DIDNT DO A BREATHALYZER and didnt see you or specifically note in his report he smelt alcoholic beverages on your breath.. PLEAD NOT GUILTY. Tell em the girl drank and then just shut up. I've seen ppl who woulda got things dismissed be found guilty after they tried to make a elaborate story and then all the details caught up and ruined it for em. Keep it simple " No your honor i didnt drink, Suzie ( or whoever her name is) drank a beer when we arrived, i was just in the car with my firends and did not drink at all" then silence... When I was 20 only 2 months from being 21. I had my annual huge party at my parents house while they were on vacation. All my friends for the most part were older or already 21. My little brothers friends showed up to the party which they were 16 or 17. Everyone was drunk having a good time playing cards out on the screened in porch, or jamming to loud music inside. Next thing I know is I see about 10 cops swarming up the road with their lights turned off, and I am thinking OH *****!! people are trying to scatter everywhere, hiding the minors and so forth...well the cops walk in and bust the party, search the parameter inside and outside. I got naked beotches in the whirl pool upstairs..so my best friend and his girl didn't know the party got busted..LMFAO the state trooper bangs on the door and my friend said F OFF, then the state trooper said ioen the door or I'm busting it down. he said F off again and quit messin around, then he stated his authority trooper Broiles badge # blah blah blah, so my friend apparently got out of the whirl pool, and the trooper wouldn't let his g/f or him get a towel LMMFAO!! they had to stand there naked. Everyone got a breathalizer. When it came for the two in the whirl pool to have theirs the trooper said ok naked boy its your turn, then ok naked girl its your turn...LMMFAO this is the crazy part. All my friends that were 21 and over were charged with "distributing alchohol to a minor" I was charged with "distributing alcohol to a minor, AND drinking under age" just because it was MY house! As far as all the minors at the party...their parents were called to either come get them or they had to stay the night. I recieved a citation with these charges on it, it was not a payable fine either, the Must appear in court box was checked. I and all my friends appeared in court we didn't try to fight it, we just plead guilty. Now 2 of my friends hired attorney's and they got out of it...however they paid almost $600 a piece to get out of it. My friends paid I think $120.00 or so in fines..I paid like $220.00 or so since I had 2 charges. This state trooper that lived behind me always hated me, so he was just looking for an excuse to bust me on something..well he got his chance. I am stuck with these 2 charges on my record..everytime I have a background check done these 2 charges always show up. I have to wait 5 years from the date it happend to try and get this expunged from my record. I will have to convince a county judge why I need this removed off my record, and he/she will make their ruleing. So ZX i'm not sure how PA handles your situation but mine is very similar to yours. I got screwed I will have my chance next year to get these charges expunged off my record since I will be 25. Honestly I don't think these charges have ever really stopped me from getting a job or anything else, I always have to explain myself first when I am questioned about it tho. I wish you luck on the situation tho. :luck:

I'm sure that Trooper that always had something against me had something to do with the way I was charged, so I really got screwed. But then again KY and PA may be different on this.

DID you actually get a "driving violation?" If it was contributing then you could do some comunity sevice or a little time. I dont know what your DLicens would have to do with under age drinking tickets, If there was no driving infraction then your Licens should be out of the equation. Not sure.. :2cents:

yep no licence or permit.....he is 14 that brings back memories..when I was 14 i stole my brothers car at 2am, went out driveing around town, raced an undercover cop, well he let me win up to 70 mph or so, then he slammed on his brakes and got behind me and flipped on the lights. I was debateing on running, but my friend said man...pull over. SO I pulled over the cop approaches the window, and I acted like I had my licence..then I "couldn't find it" in my wallet. He didn't believe me for nothing...I looked like I was 12 :lol: So officer calls my mom..my dad is out TTDY business trip. My mom comes out to get me and sign the release papers.. she hadn't drive a 5 speed in like 15 years so she couldn't hardly move the car. I remembered her saying this is a night mare as we were pulling into the shopping center parking lot...so I'm already in DEEP *****, we got back to the house and I waited 30 minutes for her to fall asleep. I grabbed the other set of keys and started walking to get the car :lol: (remember night mare) i get over 1/2 way to the car..and no *****!! that under cover cop pulls up behind me and stops, he said "WHAT the hell are you doing back out? aren't you in enough trouble?" i said man I was just taking a walk thinking how stupid I was tonight...he told me to get in the car...he took me back home, i asked him if he was going to tell my mom, and he said no, I am in enough deep *****. He said get in that house and stay put, I don't want to see you again. That was That..nuff said. I got community service after highering a lawyer..thousands and thousands of $ gone. glad thats all on Juvi records! I did alot of other bad stuff like that....I cleaned up my act when I was about 16. i wanted my licence. I think back how stupid I was during my early teen years. Atleast i am successful now.

Otherwise, you should have to wait and continue to take the driver's test at the DMV to get your license. One of the major issues that I've seen and read about in studies is the fact that too many young drivers on the road that don't know what to do. Then these idiota parents put their kids in like SUVs (cause they are safer) or the kids go out and buy some little sports car and speed everywhere. So with the SUVs being "safer", most kids will go out and speed all over cause if they get into an accident, there is more cushioning for them. Much like my friend when he ran his Range Rover over a curb, 10' up a tree, flipped it and then fell back down the tree. Before that his parents had bought him a benz and two BMWs. After the Range Rover, they went out and bought him a convertible mustang Cobra.

I would personally think the driving age is good where it stands. However I do agree with graf that there should be some stricter regulations put on that age. With freedom comes responsibility...if these kids can not own up to their actions then their license should be revoked. Simple as that.

She was driving through a school zone and was playing with the radio. Cops said she probably hit the lady doing like 45mph. She caused over $10K worth of damage to both cars. Nobody was hurt thank god, just funny though. Now you should see her. She don't go out when it snows, when it rains and she won't go over the posted speed limit. If she does, it's only by like 5mph. And if she is out and bad weather is comin', she like runs for home or some place to not drive. She'll even sit in the car until the rain / snow stops. It's hysterical. I love driving in bad weather. I drove like 90mph racing my friend to work from college in a hurricane. It was great driving through the down-pour of rain, hitting the water puddles on the side of the road and having a wall of water splash over the car. Everyone and I mean EVERYONE even the cops, moved out of my way!

Nope, I guarntee it! Most people say they can, but they come to NY and realize they can't. I've had so many people that are like, "Dude, I don't know how you people in NY do that stuff like your driving, running around like chickens with your heads cut off. I was there and I can't take it. Nope, I usually have baggy pants on, or slightly baggy. So I can feel the knees catchin' on the pavement, then when I feel that, I pull the bike back vertical.

Check with your DMV...in Florida, as a minor under 21, If you get caught anywhere, driving or not, drinking or under the influence of an intoxicant, They can suspend/you forfeit your license. It is one of those "implied Consent" thingys you agreed to when they extended the priviledge of driving to you...In Florida, they could after all the licenses of anyone under 21 caught with a drink or alcohol in their blood...it was passed as a deterrent to keep young people from drinking...
