Customized cars with dark tinted windows may become a thing of the past if state Sen. Deborah Cherry has her way.
A bill introduced by Cherry, D-Burton, would stiffen penalties for illegal window tints with a $500 fine and up to 90 days in jail.
Currently, the offense is a civil infraction with fines determined by the jurisdiction in which the violation occurs. In most cases, an offender can have the tint removed within 30 days to avoid fines, which are usually about $90 with no points added to the license.
Window tinting was in the news this past week when Detroit Piston Darko Milicic was stopped by Sterling Heights police because of dark windows on his 2004 Audi. He said he had been driving it for more than a year and didn't know it was illegal.
Lt. Gerry Scherlinck of the Troy Police Department said window tint can be up to only 35 percent in terms of darkness on a vehicle's windshield and passenger- and driver-side windows, and the tint can not exceed 4 inches.
"You can do whatever you please to the back windows," he said. "When you see some of these cars that are totally darked out, that's illegal. It poses a threat to police officers (and emergency workers) trying to see inside the car."
Denise Flannery, legislative aide for Cherry, whose district includes a portion of Oakland County, said the bill was introduced in response to a recent event in which a police officer was concerned for his safety.
"We feel the current fines are not enough to deter the illegal use of window tinting," she said.
The bill has been referred to the Senate Committee on Transportation.
The only exemption to the current legislation is a signed doctor's note specifying the tint is needed for vision problems.
Leticia Weatherby, a 22-year-old nurse's aide from Waterford Township, said she has been pulled over at least twice for her tinted windows, which she said allows officers to see inside her vehicle.
Weatherby owns a twodoor 1996 Monte Carlo and had all of the windows, except the windshield, tinted in February.
"I was under the impression that the tint shop only did the legal amount," she said. "I agree people shouldn't be allowed to tint windows so darkly that it causes a problem with the law. But I don't understand why they allow these shops to apply illegal tint but ticket you for it."
Weatherby said it costs about $179 to have the windows tinted and about $300 to have the tint removed.
"I'm not taking it off," she said. "I had the windows tinted to keep the sun out of my face and out of my child's face. If it's illegal for people to have the tint, it should be illegal for the shops to put it on."
There are no laws prohibiting the installation of illegal tint. Roger Griffi ths, outside sales coordinator with Ameristar Auto Outfi tters in Waterford, which specializes in window tinting, said his company does warn customers of the consequences of illegal window tinting but will still perform the work.
Flannery said including window-tinting businesses in the bill was "not the direction we're taking right now."
Sgt. Nathaniel McQueen with the Michigan State Police said one of the issues is tinted windows are also offered by manufacturers.
"In some areas, such as Arizona and Texas, it's legal because of the heat index," he said. "There needs to be a regulation stating it is illegal for a secondary vendor to put it on. Otherwise, you run into problems with manufacturers.
"This is really something the state needs to look into. I would think anyone proposing legislation to increase the penalty for illegal tinting should include the businesses that are putting this tint on the windows." John Sturk and Kevin Curtin of the Capital News Service contributed to this story.

EIDROEDYR 10-27-2005, 02:59 PM I've stop tinting my fronts long ago. I got tired of the tickets. I now only tint the rears. I understand the argument of a cop not being able to see inside the vehicle as well as a celebrity wanting their privacy. I do find that having tints does provide an element of security, especially for a female. The tinted windows act as a deterent for those looking to violate a single occupied vehicle.

fatburg 10-27-2005, 03:36 PM Missouri approved front tint a couple years ago. My wife really wants her tinted to match the stock privacy glass in the rear but I'm scared the law is going to change back sometime then we'll be screwed.

I also lower my windows, switch my car off, and place my hands on the steering wheel in plain view of any approaching officer, on those rare occasions that I have been caught "Fracturing" so called "Speed Limit's"... :whistle: it seems to help ! In GA people who have a medical condition which makes them prone to skin cancer can get a statement from there Dermatologist and tint all windows, including the front windshield ! They just have to keep the statement in thier vehicle at all times !

YEP!! But what I don't get is if I looked like that and was in her position of power, I would trying to pass legislation to allow window tint so I would stop scaring away the people at McD's and that way I would get my damn food. Cause she's FUGLY!

In AZ Tinting is alsmost a necessity. We have a limit in the front (pretty dark), but no limit in the back.
Tint doesnt kill cops..plain and simple. If they cant see, then use flashlights. Thats what they are for anyway, seeing in dark areas. All government officials have them (I would think). I would assume thats a standard issue item. Sounds like she is pointing the finger at somthing other than the real problem... :luck: I hope you guys get to vote on this in Michigan!!!
R1up0n1 10-27-2005, 11:14 PM I have had 5% tinted windows on all most everyone of my vehicles, and those of you that know...I've had a lot of vehicles. I have never been pulled over for illegal tint! When I do get pulled over I always roll both windows down before the officer gets up to my window, just for the fact I don't know which window he will be coming to, and so he can't hound me about my illegal tint.

I agree...So instead of rolling over and taking it, fight back. Start a letter/email campaign and tell this women to sit down and shut up. Meanwhile, when was the last time you could see into a police cruiser through the tint to see what was inside???

I don't buy into the belief that the shops who install the tint should be responsible. Any shops I talked to about tinting always show in writting that only up to a certain % is legal. Anything above that is purely for "show" purposes. They do that to cover their own ass. I mean tint is used for other purposes than car windows (i.e. homes, buildings, etc.)
So if someone ignores the warning that certain $ tint is for "show" pourposes only and not street legal then thats their own problem.
Like someone said, whats next, my iridium shield on my helmet is illegal for what ever reasons. Blow me! :cheers:

I have my side and rear windows tinted to 20% visibility and my ENTIRE windshield at 35%. Good thing I live in Florida where this is illegal but nobody cares!

ScottSellersUNR 10-30-2005, 01:39 AM my tint is illegal, but cops here couldnt tell me the law when i asked..lol So ive never had a issue.. though when pulled over in Cali they say its illegal, but since i have NV plates i dont worry aobut it, id fight it in court. It does keep the truck cool, and is more secure, ppl dont wanan start crap with someone they cant see. My truck is limo tint all the way around, with a huge sticker in the windsheild darkening it a bit more, can only see in if light is coming in thoguh the windsheild.. i love it that way and would pay he fix it beofre id remve it.
jeeps84 10-30-2005, 08:13 AM I usually tint windows in most of my cars/trucks. At one time 35% on front side windows was legal here in NC. Now the use a light meter at inspection stations and some traffic stops.
The issue with the meter is,
If the window tested is not in BRIGHT light to start with. The meter reads its darker than it truly is.
A friend runs an inspection station and showed me this.
Using a standard piece of non tinted house hold window glass. The meter tested the glass to be 2% tinted in bright light. Just hold the same glass in the shadows and it reads 30%. WTF? The cops are using this as a test. To make things worse. If the cop wants the tint off your windows. Some have cut/ripped the tint while telling the owner it needs to be removed or they get a big ticket. Personally I would sue for property damage if that was to happen to me.
