NEBRASKA CITY, Neb. - Speeding is not necessarily reckless, even at 128 mph, a judge ruled in the case of a motorcyclist who tried to flee from state troopers.
With some reluctance, County Judge John Steinheider ruled last week that Jacob H. Carman, 20, was not guilty of reckless driving on Sept. 5, when he was spotted by a trooper who then chased him at the top speed of his cruiser's odometer — 128 mph.
"As much as it pains me to do it, speed and speed alone is not sufficient to establish reckless driving," the judge told Carman on Friday. "If you had had a passenger, there would be no question of conviction. If there had been other cars on the roadway, if you would've went into the wrong lane or anything, I would have convicted you."
Otoe County prosecutor David Partsch acknowledged that Carman could have been charged with speeding but, "We felt that the manner in which he was operating the motorcycle was reckless."
Carman didn't get off entirely. He was fined $300 for expired tags and other violations
I can not explain how awesome this is!!!!!

i want a judge like that in OH, in every court on every bench (he must have a bike, no cage driver would think like that< even if it is common sense!!)

In some states it is a set limit, I think Here in IL anything over 60 over is wreckless. I was pulled over for 100 over :willy: :willy: and its was automatic. I was doing 125 in a 25 in a cage

Well I think that with a good lawyer you could use that court case in your defense....

I don't think that riding at high speeds (over 100) by itself is reckless...To me, reckless is when your actions pose a "situation" and not necessarily "a danger" to others. You can be reckless driving through a school zone in your cage at 20 MPH eating your McGriddle is you run some kid off the road on his bike. Or if you are swerving in and out of traffic at the posted speed if you cause someone to do something foolish.
We go out into areas of the forest where there are very few people around and open our bikes up...does that make us reckless...or foolish?

I hate the entire idea of reckless being cookie cutter to cops. It just isn't the case really!

speed isn't reckless, yeah it might be if ur lanesplitting at 175 and theres a bunch of cars around then hmm maby...lol
if you not skidding and messing up and ur using out-in courning and ohh for get it. it shoudl just be speeding al they way weigh u suck at riding or are mat maladin

The fun for me isn't in winding it up on the straights, its railing through the corners. Yes, we are well above the recommended speed for the corner, but not so much over on the straights.
But as far as highways go, one mans cruising speed may be what another considers reckless.

:withstupi My cruising speed on the highway when on the 9R was like 100mph.. passing cars quickly was like 145+
