:cursin: :cursin: :cursin: Well guys, the inevitable has happened.
My day was going great yesterday. My girlfriend had called me to see if i would bring her swipe card for the resrtaunt that she works for. No problem. I got geared up and took it to her.
After I gave her the card I was on my way and decided to go out to the interstate which is only an 1/8th mile away from where she works, and then go back to home through town. So im going down there interstate and the traffic is moving slow as hell and there was a lane blocked off.
Aparently they were painting new lines on the road! :cursin: Well of course you cant avoid getting some overspray on your ride so i waited until the cars in front of me went through and then sped up fast so not much got on the R6. Of course it did. I hate that, dosent matter if its on my bike or my truck.
Well, I finally got to the downtown exit and started going down the street to downtown. Got to down town and was going to ride around for a little bit then head home. Once i got into downtown my gas light came. I thought to my self ok, I will just head over to the normal gas station I go to and then head home.
So I am on the way to the gas station only a mile and a half from my house I come up to a line of cars that were stopped because the one in front was trying to make a left turn in traffic.
I come up to the back of a jeep cherokee and stop a few feet shy of it. About 10 seconds later i hear a loud screeching, then before i knew it BAM. Im flying through the air. I land and the bike lands a little on top of me. HOLY **** did this just hapen???:yikes: She rearended me at about 40 mph! Sandwitching me between her and the jeep that was in front of me. I hit the ground hard but i didnt really slide much. My side was in mad pain and it took a good 20 min for me to even get up. Not 5 min later there were 15 cops on the scene with fire dept and then the ambulance.
The Dumb Ass girl that rearended me didnt even see that everyone was stopped in the lane so she came into the left lane to get out of the traffic from the right lane.
Well, i didnt take the ambulance ride to the hospital thought i was fine at the moment. I ended up going about a hour later and got my girlfriend to take me. At least it was the fastest er visit i have ever seen. Only 4 hours.
It turns out, I have a brusied hip, uper and lower left leg are bruised pretty bad, sore neck, over extended right ankle, and minimal rash on my left leg.
I was wearing my normal gear, helmet, jeans, joe rocket jacket, and some oretty thick shoes.
My baby is totaled out, she will never ride again. I went today to the towing company to get the papers and stuff out from under the back seat. The key broke off in the ignition after the wreck.
Thats just great, riding season just really got super nice and now i dont have a ride!:upset: :upset: :upset:
Well I will post some pics on here as soon as they get approved and all that. they arent great(from my cell phone) but they are decent.
Im just sad and sore as hell now. My baby that I drove off of the showroom floor with the odometer reading 000000 is now gone.
jtemple 04-07-2006, 03:53 PM That sucks.
I hope my 000000 mile baby lasts a looooong time.
Glad to hear you are ok man. That is the wreck I fear the most. Unfortunately it happens way too often. You should get a nice fat insurance check to get you a brand new 06 000000 baby though.
Thanks guys, It sucks pretty bad. They gave me a Rx at the emergency room for some muscle relaxers i have never heard of and something else i ddnt know. They really dont seem to help much at all.:damn: :disapp:
I will post some pics on here as soon as they geet approved.
JLBusa 04-07-2006, 05:54 PM :yikes: Oh man, thats horrible!!! My condolences on your loss but glad to hear that you made it out okay, it could have been so much worse for you!! :luck: finding a new baby!

Homer4598 04-07-2006, 06:58 PM Sorry to hear that. That is definitely the type of accident I fear the most. Did the idiot who hit you get a ticket? Beaten? Something?

Here they are, they arent the greatest pictures (from my cell phone), The black car is the one that sandwiched me between it and the white jeep.
I dont know about yall but it was awfully hard watching the tow truck guy winching it across the pavement onto the flat bed.
As of right now, The er gave me a rx for some pain killers and muscle relaxers. They arent helping much at all right now. They were ones I have never heard of. Oh well
man, you are so lucky to only be sore.
ne1469 04-07-2006, 08:39 PM man, you are so lucky to only be sore.
no joke:yikes:
R1up0n1 04-07-2006, 10:16 PM that sucks AUR6! Atleast you are still alive. A few bruises will go away over time. Hope you heal soon, and get a 06 R6.

:yikes: :iagree: You will be sore for a few days. A trip to the dealer to lay claim on a new bike curtsey of the Biotches insurance will help ease that pain.

jeeps84 04-08-2006, 12:32 AM Let’s hope she had insurance.
Gas Man 04-08-2006, 09:49 AM This is why they say flash your tail lights at the cars coming up your rear and always leave yourself a out.
I know I am always looking in my mirrors at least until I have one car stopped behind me...
jeeps84 04-08-2006, 10:30 AM Another reason you will rarely see me stopped directly behind another vehicle. I usually stop to the side. If I get smashed from behind. Hopefully I wont get smashed in-between the two.
Thanks everyone for all the good thoughts and words. This is a testament on how good this forum is and for everyone here.:dthumb: :twfrox:
It should be a pretty good pay off, hell she was practically brand new with only 3100 miles on it. Never been laid down, there wasnt even a scratch on it.
I plan on getting everything out of it:
The bike
The taxes paid on it
Jardine titanium can
custom under tail w/integrated turn signals
Michelin pilot power front and rear, they had less than 200 miles on them
the er visit
the Rx filled
my sunglasses that got all bent up
If anyone thinks of something else to claim that would be great. The exhaust and undertail were the only aftermarket things on it.
Again thanks to all and hopefully I will be back riding soon. This wreck isnt going to deter me from participating in the greatest sport out there.
Hmmmmm, maybe I could claim a full aftermarket exhaust......
jeeps84 04-08-2006, 02:37 PM Its hard to claim aftermarket pats at all. Insurance will usually pay for factory stuff but it almost always higher than the aftermarket stuff. That puts cash towards other parts. On a total loss like it seems you have. It may be tuff to get much more than a replacement bike.
Don't forget to claim you jacket, cloves, helmet and any other gear.
itgirl25 04-08-2006, 04:24 PM i sure would hope that you would sue the pants off this girl! some people need to learn the hard way to pay more attention. she coulda killed you. glad you are in decent shape though.

That's weird, I am pretty sure my issurance actually has a deductible for aftermarket mods and gear. GMAC rider is who I have.
jeeps84 04-09-2006, 02:01 AM Not weird at all. It all depends on who you have and how your policy is set up.

:iagree:
Gas Man 04-09-2006, 09:50 AM Yeah...I know its no biggie on the aftermarket parts. Most factory parts are more money. When my 9R got caught in a storm and blew over..one of the parts hit was the muffler... the stock can... it retailed for $900... so I order a Micron slip on and a scotts stabalizer for the same price!
Good call by Jeeps on the gear though and It for suing the bitch. She could have killed you! Sue that bitch!
jeeps84 04-10-2006, 01:14 AM Any news on what the insurance is offering yet?
Any news on what the insurance is offering yet?
Not as of yet, She had some insurance that the folks at state farm havent heard about:willy: . Hopefully i will hear something on it later today. I am letting state farm handle pretty much everything on my end, as soon as they talk to the claims dept with her insurance they are going to call me back and we will go from there. As soon as i hear something i will let yall know.
Ive been looking around for another bike, I have seen some pretty good deals go down on ebay on R6s and R1s the past couple of days. I dont know what my insurance would be like if I went to a couple year old R1. i remember when i got my r6 they quoted me somewhere around 2500 a year. Which is high but not even close to what geico and progressive offered me. They were in the range of 3200 to 4800:yikes:.
Any way I will call state farm up later today and i will post back what they say.
marko138 04-10-2006, 06:32 AM Jeeps beat me to it...but def. claim your gear man. Assume that s#!t is whacked too. :sorry: to hear about this bro...but most importantly...atleast you are alive. Coulda been so much worse.
Your :twfrox: bro's and sisters are here for you. Keep us updated....
And hopefully her 2nd rate Ins. Co isn't going to shaft you.:luck:

I hope you're gonna get an 06 R6 now. I was at the WERA races this past weekend and those things were hauling ass!! Couple of first place finishes.

see I disagree with the thought of sue'n her espically if you get all your asking for paid... yeah it sucks... but it was an accident... happens to all of us at times... but yeah... Clame your gear. and get all the rest paid off...
now if they don't pay for it all... THEN I'd consider sue'n... :2cents: though

:nonod: silly boy...i dont really agree with the whole "sue sue sue" thing either, there are so many better and more positive things to do with time...but it is a good thing sometimes when dealing with insurance companies to mention "i would be more than happy to have my attorney call you..."and as a last resort maybe sue...
:jacked: i work for attorneys and I am often disgusted by the stupid things people do and then want to sue others...like tripping over a crack in the sidewalk, then suing the company whose parking lot you were in...c'mon, how bout we watch where we put our feet...:chair:
(back on topic) but in this instance, he would be within reason to sue if they dont take care of him properly...

marko138 04-11-2006, 05:17 AM Any updates from the Insurance AUR?
Ok me again, Not much of an update so far.
I talked with my insurance two days ago and they said that they talked with the girls insurance on friday the 7th. They told me that I should expect a call from the other insurance company in the next day or two. Well now its wednesday the 12th and still no word from them. State farm gave me the phone number to the girls insurance if I wanted to call them.
I am in the dark with this whole process, I mean state farm has told me roughly what to expect, But I have never had a wreck and never had to deal with insurance other than to make payments for the policy.
How long have yall waited for the other persons insurance to contact you and begin the clams process?? What are some things to expect??
Its killing me not having a ride right now, hell my dad offered to give me back the gn400 that I bought for him years ago instead of getting a new bike but going from a kick start single cylinder 400 thats 23 years old (but still runs great) to a 05 r6 there isnt any comparrison. Maybe i will go for a used r6 or something similar and use some of the payoff money to go towards my loan for the original r6.
ebbs15 04-12-2006, 02:09 PM Maybe i will go for a used r6 or something similar and use some of the payoff money to go towards my loan for the original r6.
You shouldn't have to... if it's totaled they should pay it off!... unless you were in the hole on it by alot... I know I said not to sue... but if they keep giving you the run arround... I'd be look'n for an attorny... at least that way the time you can't ride you'll get re-embursed for...

Freindly Fire 04-12-2006, 05:09 PM I am  to hear your safe mate, But I disagree with the not sueing her. It was not an accident, it was a crash when you label it an Accident people say ohh it was just an accident. Well it's not she had her Head space and Timing off ( Her head was spaced so far up her ### it messed up the timeing between her brain and her body) and this would be different if he cause the crash. I think that it is a valid lawsuit, I really would be against it if he was at fault or this was something frivolus like him dropping his bike in an oil spot in a parking lot and trying to sue. Anyways I hope you can get back out before to much longger on your new (new to you) ride.
P.S. Its just my opinion not a flame.

sorry for the :jacked:
I understand what yall are saying, I understand that people make mistakes and all. If her two bit insurance dosent pick up the pace and at least try to make contact :here: with me then it might escalate to more than what it is, or if they try to give me some bs settlement. The girl did seem to be pretty ditsey (no offence to the ladies on here.) I am willing to be rational about all this, but I do have a fairly mean side, So if they want to play hardball then so be it. I will give then through friday. I think a week is more than necessary to get the ball rolling. If they dont contact me by then, I will call them monday and see what the hold up is, and more than likely be pretty pissed. :cursin:
The one good thing you got going for you is that your bike is totaled and they have to replace the whole thing. When I got into a car wreck that wasn't my fault, I fought with the guy's insurance for 3 months about replacing the damage parts with OEM parts and not their parts from god knows where. I finally threatened legal action and got the money for the estimate I received through Honda.
jeeps84 04-13-2006, 01:59 AM :welcome: to TWF Freindly Fire
If your satisfied with your medical condition and don't expect any further complications. Contact them and get the ball rolling. They are probably waiting for the medical all clear to start negations. Or to see if they are contacted by a Lawyer contracted by you. Personally, I think if your not really hurt and haven't lost time at work. I wouldn't sue. The insurance may offer pain and suffering/lost time settlement to go along with medical expenses and property damages.
marko138 04-13-2006, 05:40 AM Def. try to be convenial about it...but if they are trying to give you the shaft mcgillicutty then def. lay the :motz: down on them.

sorry for the :jacked:
my sister had an accident once in her toyota MR2 (she was 16). it was winter and she hit a patch of black ice in a valley between 2 hills. she slid into the other lane and hit a car with 2 other teens in it. it truly was an accident, coulda happened to anyone. my sis' car was totalled, but the only injury was to the one male passenger in the other car, he broke his wrist. anyways, he sued my parents. he walked away with $100,000. it didn't affect our family personally, the insurance co. got hit with it and my sister's rates went up obviously, but we didn't personally experience any financial strain from this. so chances are this girl will be unaffected too if AUR sues her, and she will live to run over another biker another day. she needs to be made aware of how serious her actions were. i still say SUE!! i know i would. there is a time and place to be the bigger person, but this is not it. seize this opportunity man, i would.
Gas Man 04-13-2006, 08:26 AM Yeah...but you are still jacking up her rates! She won't soon forget that she got sued!
Listen... I'm not a "sue everybody" type of a person. But when these dumbass ****ers keep doing this stuff and not paying attention... people get killed.
marko138 04-13-2006, 08:49 AM :motz: bastards who run over motorcycles.
Well, still no word yet. In my opinon this has gone on too long without any word from them yet. I am going to go to my insurance agent today and see what is up with everything and give them more recipts from the different things on the bike and some medical stuff too. I havent recieved the bill from the emergency room yet tough.
I stopped in the local yamaha shop yesterday. It was hard not to tell them to get the paperwork going. I sat on a new 50th anniversary (sp?) R6.   That bike is so sweet. I also looked at an R1 but I know I wont get a new R1, too much insurance and. But hell the price difference from an normal R1 to a 50th R6 is almost nothing. Maybe I will look into getting a 03 or 04 R1, i dunno, the r6 was really good to me too.
Any way, i am going to go and talk with state farm and run some more errands. I will post back what they say later on.
Gas Man 04-14-2006, 02:17 PM Are you in a no fault state?
Are you in a no fault state?
I dont know. What does that mean??
Gas Man 04-14-2006, 03:28 PM For example... Michigan is a "NO FAULT" state... which means in your case... your insurance company just fixes your stuff regardless who's fault it was!!
Ahhhh, i see what you are saying. I dont know if alabama is or not. They did give me the option when i first went in after the wreck to contact her insurance and me and them work it out with state farms help, or to make the claim with state farm pay the $500 deductable and they would take care of it after they settle with her insurance the first 500 bucks they get out of her will come to me. I chose to go with the first option.
jeeps84 04-15-2006, 01:33 AM You paying the deductible and your insurance fixing your bike would be a no fault claim. They would still go after her for the money. It just gets you back on the road quicker.
marko138 04-17-2006, 05:47 AM Any new developments w/ the insurance?

never stop in traffic directly behind another car...ALWAYS stop on the left or right of the car in front of you. In case a car behind you doesn't stop, you don't get caught in between. Also, the driver of the car in front of you will see you in their mirrors and know you are there. If you can see the car coming, you can lane split and avoid a direct hit...
Sorry about the accident...hope you like the new ride she will be buying you soon...

Ok guys, Sory i havent been on for a good while, My dead beat roomate hasn't paid the damn :bslap: internet bill in two months and they cut it off last week.
Well, The insurance company is geting things going pretty good now. They have made me an offer for the toatled bike and after market stuff. They are offering 8600 including the bike, Brandnew pilot powers, exhaust and fender eliminator, taxes paid and the such. Not including helmet and jacket.
I thought it was pretty good offer.
The medical claims people are not being as helpful though, i wont go into what they are bsing about, but its nothing major and i wil be able to handle it.
It appears that i will have to go through a 3rd claims process to get reimbursed for the helmet and jacket. I am yet to talk with them on the process of that though.
All in all i think things are finally going well. I am not going to sign anything untill i have all 3 claims in order so i dont know how long its going to be untill all this clears up.
I will try to post back when i can but being without the net its a real pain in the ass right now.
Thanks all.

You should be able to sign off and settle each claim individually. Just make sure your happy enough with bike settlement that you can afford to lose the gear claim.
marko138 04-26-2006, 04:40 AM Keep us up to date.
bumblebee 04-26-2006, 12:09 PM Why should you give up anything??? She hit you from behind while you were stopped...there is nothing to argue about...they pay for all bills...You still need to sue her even if it just gets you a record of her being "At fault"...never know when she might hit the Lotto...
Also...I have discovered that as soon as she and her insurance company are served with the lawsuit papers and you refuse to speak with anyone from her company...ALL the runaround BS stops immediately...They cannot afford to get this into court...In your suit, you include the filing and Attorneys' fees...They will pay up, and then you can drop the suit before the court date...
marko138 04-27-2006, 06:33 AM Yeah man...do not settle for anything less than having every piece that was damaged, bike, gear or otherwise, replaced.
BoyScout 05-17-2006, 05:50 AM Hey BROTHER,
:iagree: Like everyone else has stated, a few bruises, you are doing quite well considering what happened.
2 Wheels 1 love
eaglerider94 06-26-2006, 11:32 AM :cursin: :cursin: :cursin: Well guys, the inevitable has happened.
Glad to know you didn't get hurt too bad. In the future, it is always best to sandwhich yourself between two stopped vehicles. I always do as there is alot of dumbass people out there on not paying attention and talking on their cell phones. Get an attorney, get checked out and work on getting a new bike.
eaglerider94 06-26-2006, 11:41 AM Ok me again, Not much of an update so far.
Get an attorney. Believe me, this can become very complicated especially because you sustained injuries. No telling what will come back and haunt you a few years from now. There are many reputable attorneys which represent motorcyclists, just becareful choosing one.
Back off pal...quit taking all the credit. Credit hog.
:iagree:
marko138 06-27-2006, 05:07 AM Old thread alert. What is the story with this? Still waiting?

yeah this is the first time I read this one but now Im very curious as to how it ended. I REALLY WANT TO KNOW.
brockster 06-27-2006, 11:56 PM If you don't want to get an attorney (just yet), contact your state's department of insurance if they are still jerking you around. Sometimes that's a good wake up call to State Harm so that they know that YOU are exploring your options seriously.
I was rear-ended in a car wreck a few years back. I felt tired and run down for about three weeks after that. Turns out that I went thru two or three months of chiropractic (not a quack BTW) treatments until I felt better. Sometimes you don't know you've been hurt until much later.
marko138 06-28-2006, 04:55 AM Contact someone...don't let these MF's shank you.

:withstupi I have had 2 really "good" car accidents and will peridocially need chiro care for the rest of my life...it is worth it!!
Gixxer911 06-28-2006, 09:58 AM Good to hear you got through it with minimal injurys. Don't play with ins. company's man they will get over on you. Get a lawyer on them now. Don't wait.

A proper yoga work out will help keep things aligned also. I have a lower back problem that cascades from a knee injury. By "Proper" I mean work with an instructor that understands the injury (not someone with a teaching cert. at the local gym) And is certified in yoga therapy. They'll set up a work out to help you, and tell you want moves NEVER to do (or you'll agravate the injury)... Not all yoga is contortionist, most of it is strength work and stretching.:2cents:
Stunt4Life 09-26-2006, 05:18 PM Hope recovery goes well!
