A suspected drug house gets raided but the only thing that was found was a half smoked joint and a roach clip. The husband, wife and 12 year old son are taken into custody. The husband and wife and jailed while the minor child is awaiting child protective services. As the officer's are searching the house, one officer finds a toy remote control chevy avalanche. He picks up the remote, move the controls and run the truck into the wall. The truck falls over on the side and a two pound bag of uncut cocaine falls out. Who should get charged?
Both would be charged even if one admitted to it being theres. Say the man agreed it was his and then he would get the charge for the drugs and then the woman would be charged for knowing that it was happening with there child in the residence. Both are guilty, got to love drug users and dealers that only think about there self not there child.
it would be who ever's house it is... because they can't prove possesion to the kid or either parent... I would think it comes down to the homeowners or who ever is on the lease's responsibility...
then again re-reading it... who did they suspect when they raided the house? the kid or the parents? I'm sure they'd wrap the charges up with that person :2cents:
#2 I think both parents should be blamed for it. Even if it was the 12 year old boys, it was the parents fault. How many 12 year olds do you know that have access to 2 lbs of cocaine.
WOW, no one said the obvious.......the person who will get charged is who ever fingerprints are on the goods. And to set the record straight, it did belong to the 12yr old, he was holding it for someone. The house was raided because it was a supposed "drug house".
And besides...the Anti Drug Abuse Act was enacted as a way to get rid of the US Constitution. It's already working.
