New Mexico Man Arrested For "Extreme" Animal Cruelty

POSTED: 7:46 p.m. MDT July 15, 2005

KFOX News At Nine

On July 13, 2005, Dona Ana county sheriffs deputies arrested 35-year old Able Hernandez on animal cruelty charges- animal cruelty is a felony in New Mexico.

"This is a very bad case," said Sgt. Ronnie Granados of the Dona Ana sheriffs department. "The animal had suffered quite a bit."

Investigators allege Hernandez moved from his home, north of Las Cruces, and left his dog behind.

When animal control arrived, they found a dog that had been left without any food or water for a week.

"This was extremely bad," said Dona Ana county animal control supervisor Ellie Chote.

The animal, with a chain so tight around its neck that it left behind an open wound, was found with an estimated 2,000 ticks on its body.

Hernandez remains jailed at the Dona Ana county detention facility under a $10,000 bond.

**Current penalty for animal cruelty in New Mexico : Currently, the state statute says a misdemeanor, and even if multiple charges add up to a felony, a $1,000 fine or a year in jail is not much of a deterrent.

Funny thing is that New Mexico ASPCA says that if you can't take care of the animal, just call them, they'll come pick it up and take it away, no questions asked, you'll just have to sign a release form.

The way people treat their children, why would this surprise you??? Oh I forgot, you are still a child...

Dude, seriously, if you're calling me a child then you gotta be like 45+years old. So in that respect, yeah, I probably am a child but at least my equipment still works, ain't shrivelled up, dryed out and hanging off to the side.

OUCH!
Its to easy to find a foster home or give a animal up to a shelter for this shiot to happen.
Why don't people just let'em go?
At least it would have a chance to find food and even a new home.

That's what I don't ever understand about it.

1. Can't take care of it, give it to a shelter or someone who can.
2. Don't have adequate spacing and time for it, don't get it.
