What kind of :rant: wins an item and then doesn't pay??? I sold an old Honda CB750 Custom on ebay last week and it pulled a decent price of $760. However, the :rant: that won it sent one e-mail saying that he would pick the bike up Saturday (23rd) and pay cash, but he would need directions. So I send him detailed directions, as well as my phone number. The :rant: never calls, responds, or shows up. Just plain drops off the face of the earth. I had sent him an e-mail Friday asking him if he was still coming up on Saturday. No response. So I sent an e-mail Sat morning asking him to please call so that I know when to expect him. No response. I sent an e-mail Sat night asking him when he was coming up. No response. I've sent countless e-mails, IM's and other messages through e-bay, but the :rant: hasn't responded to a single message. :cursin: So now I have to file a non-paying bidder report with e-bay, which basically doesn't do a damn thing except put a "strike" on his record (I'm sure he's SOOOO scared) and it gives me my final value fee back and allows me to relist the bike. Woop-de-f*****g-doo!! :cursin: Now I have to hope and pray that the bike gets back up to the same amount. I'm going to first try the non-winning bidders, but I'm still stuck with less than what that dips**t would have paid. :cursin: :cursin: :cursin: :cursin: E-bay should really allow people to sue since they claim that the auction is a binding contract.

yeah, definately give that chump a nice hefty load of negative feedback...did you ask for a deposit or anything, to be paid within a day or 2 after the auction that ended?

I had asked for payment within 3 business days. Of course, with E-bay, you can't file a non-paying bidder complaint until it's been at least 7 days, so my 3 business day request doesn't matter.

man that really blows..im sorry for ya dude! people like that just suck..he probably went ahead and put the bid for auction, then his wifey found out about it and said no way..so now he falls off the face of the earth instead of facing the music and owning up to his end of the bargain.! :rant:

Ohhhh yeah! THAT really sucks! I know my hubby used to get so pi$$ed at non-paying bidders. (He used to sell memory for computers and he used to build computers and sell them on ebay.) He always said that ebay needed to reconstruct their buying-selling guidelines.

i dont sell much on ebay, but I buy things now and then...doesnt it state about bidding on/winning an auction is a legal contract that you must fulfill ? If so, I would think ebay could do alot more to get the people to pay up if they wanted to, than they do now. :confused:

Yeah it is...but what are they going to do. Take you to small claims court over a $50 EBay part....

It does suck. Not to mention they give you back you final fees but not your listing fees. That blows because when the buyer doesn't pay up you can get the final fees back but then you have to re-list it and get charged the listing fees AGAIN! I know!!!

So now you are whoring with Gasman Twisty? Is that where you are selling the camera mounts and why you haven't responded to my 8,000 requests to get this thing together with Dyno and Haz? MFP. I asked before if you wanted anyone else involved but nooooo.. You two are cheap whores.

I hate non-paying bidders on Ebay. It is enough of a pain in the ass to list, pack, ship, etc. that you don't need that headache as well.

Thanks to the members of corvetteforum, I was able to find out how to get contact information from Ebay. Ebay only sent me the guy's phone number, but through the magic of reverse directory, I also have his address. I wasn't able to find it in Yahoo the first time because it's listed as ELMER West, not JERRY. But I have it now.

I called and his sister answered. She claims that he's in the hospital getting a liver transplant and that he went in two days ago. I'm not sure that I believe her, but who knows. Elmer is their father and has Alzheimers. The sister is in town from Germany because their mother passed away and Jerry is in the hospital. She gave up that information rather freely, which is why I'm not sure that I believe her.

Someone else is in the process of trying to verify the liver transplant claim. It may be true, in which case, I'll feel bad for the guy. However, I won't know for sure right away. Plus, his sister said that he got the call a couple days ago but she didn't give an exact date so I don't know if he would have had time to send out an e-mail or call and let me know. Granted, if I was going in for a liver transplant, an ebay transaction would be the LAST thing on my mind.

Also, the next highest bidder (only $10 lower) already bought a bike. Unfortunately, the third highest is $150 lower. So, assuming Jerry IS really getting a liver transplant, how long do I wait for him to say that he doesn't want the bike before I move on and try to sell it again?

if you cant get a concrete answer from him if he wants it or not, I'd say go ahead and relist it..just keep records of everytime u tried to contact him, what you did, what info EBAY gave u, etc.. that way you cover ur arse..

Hmmm, my source says that the liver transplant thing is a farce and that the guy has been in trouble before and has a record. Also gave me a different phone number than the one that ebay provided.

Now here is another twist. I read his feedback and everything was positive, but this time I also chose to look at the feedback that he had left for sellers. On one big item (a Bronco II), the seller put that the transaction was great and he would do business with buyer (Jerry) again. However, the feedback that Jerry left for the seller said that he "found a different truck at the same price thank you". :confused: So I sent the seller an e-mail asking about the transaction and describing my situation as well. Hopefully, I'll get a response soon.

Now I'm wondering, do I call the phone number that my source provided to me right away? What exactly am I supposed to say? If I mention the motorcycle, he can just claim ignorance since it IS a different number than what Ebay provided. What if these are actually two different people?

Ugh, what a PITA

dont know how much persuing this is going to benefit you..the guy is obviously a complete screw up...i'd just let it go, leave him some feedback, the negative kind, and relist it..just my :2cents:

Yeah, that's what it's looking like to me. I also called the number that Ebay had provided (his dad's house) and his sister answered again. The guy does NOT live with his dad, and I confirmed the number that I got from my other source. Looks like I got hosed. I'm still going to call my attorney and see if I have any other recourse to recoup the difference or possibly force the guy to abide by the contract.
