A memorial sign was erected outside Denver for a motorcyclist who was killed by a careless driver. The married father of five rode his bike to work every day. What's weird, is the driver who killed him caused another crash at the very same corner three years earlier. The standard penalty for a vehicular crash which results in the death of a motorcyclist is a 4-point "careless driving resulting in a death" ticket. This is a weaker penalty than that levied against a careless driver who causes the death of an occupant in a car or truck. A state senator is working on new lesislation to correct this. What is the penalty in your state?

I'm dealing with a similar incident. The lady who killed my friend last year while under the influence of narcotic has pleaded no contest and may not even serve a day in jail. The DA says that because she is in her 60's and no previous record they wouldn't get any prison time.

So now we have to plead our case to the judge at the sentencing hearing in an attempt to get the maximum sentence of only 365 days in county jail. From what I hear she'll probably get off with probation and nothing else.

That's all you get for getting behind the wheel while under the influence and killing a 33 year old motorcyclist. He was one of the finest men I've even known and for his killer to get off with only probation is a travesty.

Well, we were able to get the maximum allowable sentence under her plea bargain. She will spend the next 365 days in jail.

I can't believe I live in a world where a woman you who drives under the influence of a narcotic and kills a man only has to serve one year in jail while a woman who puts a thumb in a bowl of chili gets nine years in prison.

I hear what your saying but let me say this... I had a friend killed riding a motorcycle... by another friend of mine... they didn't know each other... actually I think I'm the only person who knew them both... she was sentenced to 2 years in Jail for vehicular (spelling?) homicide... on one hand my friends (of the rider who died) were outraged that's all she got... and the girls family( the driver) were upset at the punishment... she didn't do it intentionally... she wasn't under the influence of any thing... she wasn't speeding... she just swerved to miss a dog and crossed a double yellow and hit my friend... being in the middle I felt bad for both partys... but in the end... she is scared for life... she's been out of jail now for 4 years and still won't drive... she has been in counceling every day since the accident... she's just a shell of the person she was... as are the Riders parents... he was their only child and they just seem to have lost the lust for life...

my whole point is this... that lady is going to have to deal with the fact that she killed someone... something I hope to never have to experience... and no amount of jail time is going to lesson that... nor is it going to bring your friend back..

I don't pretend to know you or anything about your friend or the woman or the situation... I just wanted to provide another point of view...

that said... I'm deeply sorry for your loss... be safe out there...

I would feel better about the whole thing if I got the impression that she felt remorse, but I didn't. I would have felt a lot better about the whole thing if she would have stood before my friend's widow and family to say she was truly sorry, but she didn't. All I heard was her lawyer arguing that she was wasn't under the influence in the first place. She didn't feel like she was impaired and called her running a red light an accident. There are true accidents out there but this was not one of them.

I feel sorry for your friend who has to deal with killing another. Sounds to me like it was just an unfortunate accident that will probably haunt her for the rest of her life. I know it would haunt me as well.

I feel sorry for the family of the man who died. In my case, I could only hope that the women who killed my friend realized what an incredible person he was, and felt sorry for what she had done and will learn from this and not do it again. That alone would have meant more to me than any time she spent in jail.

Understood... my friend did... she stood up in court and plead guilty... but before she did she told the family how bad she felt... and how sorry she was...

I wasn't there so I won't judge the lady in your case... but even if she wasn't at fault... she should still show some sort of regret that the incedent happened... just common sence...

and yes... to me running a red light is not an accident... it's a lack of awarness... :cursin:
